What you agree to when your site goes live.

Ferraro Systems builds and runs an online ordering site for your restaurant: a menu your customers order pickup from, a tablet view where the orders arrive, a kitchen ticket that prints, and the emails your customers get. We host it, keep it running, and make changes to it when you ask.

There is no setup fee and no monthly fee. You pay a percentage of each order placed through your site. The percentage is agreed with you in writing before we build anything, and it does not change unless we both agree to change it. It is calculated on the order subtotal, before tax and tip.

Once a month we email you an invoice for the orders placed through your site that month, with the order list attached so you can check it. Payment is due within fourteen days. If an invoice is more than thirty days overdue we may pause the site until it is paid, after telling you first.

Customers pay you at pickup, at your counter, by whatever you accept. Ferraro never holds or handles your customers’ money and never charges their cards. Refunds, no-shows and disputes are between you and the customer, the same as a phone order.

There is no minimum term and no exit fee. You can stop whenever you like by emailing us; we take the site down within a few days and send a final invoice for orders up to that date. We can also end the agreement, with thirty days’ notice, or at once if an invoice goes unpaid for sixty days or the site is used for something unlawful.

Your menu, your prices, your photos, your name and logo, your domain, your orders and your customer list are yours. You can export orders, customers and the menu to CSV at any time, and we will send you a final export when you leave. The software itself, and the way the site is built, stays ours.

You keep the menu, prices, hours and allergen information accurate; you make the food and hand it over; you charge and remit your own taxes; and you have the right to use every photo and name on your site. If a customer is harmed by something you sold, that is on you, as it would be with any order.

You can use your own Android tablet and receipt printer, or we can supply tested ones at cost. Hardware we supply is yours once the invoice for it is paid. We help set it up; we do not repair or replace hardware we did not supply.

We run the site on Vercel and Supabase and aim to keep it up around the clock, but we cannot promise it will never go down. If it is down, you owe nothing for that time, and we tell you as soon as we know. We are not liable for lost orders or lost sales while it is down.

Our total liability to you for anything to do with the service is capped at the fees you paid us in the three months before the claim. We are not liable for indirect losses such as lost profits. Nothing here limits liability that the law says cannot be limited.

The demo storefront at marlowe.ferrarosystems.com is for looking at and trying. Orders placed on it are not real, nothing is made, and nothing is charged.
